Alonga Fácil Terms of Use

These Terms govern your use of the Alonga Fácil application, provided by Marcus Flávio Costa Magalhães, based in Brasília, Federal District, Brazil. By creating an account, you acknowledge that you have read and accepted these Terms and the Privacy Policy.

1. Eligibility and account

The App is intended for people aged 18 or older. You must provide accurate information, keep your credentials secure, and immediately report any suspected unauthorized access.

Your account is personal and may not be shared, sold, or transferred. You are responsible for activity performed with your credentials, except when caused by a failure attributable to us.

2. Purpose of the App

The App provides self-reported mobility assessments, exercise routines, educational content, history, and progress views. Scores, classifications, and suggestions are guidance based on the information provided and do not constitute a medical diagnosis, treatment, or prescription.

3. Health and safety

Before exercising, make sure your environment and equipment are safe. Stop immediately if you experience pain, dizziness, shortness of breath, numbness, or unusual discomfort.

Consult a qualified healthcare professional before starting if you are pregnant, recovering from surgery or injury, or have a cardiovascular, neurological, musculoskeletal, or other condition that exercise may affect.

You are responsible for choosing a range of motion and intensity appropriate to your condition. No instruction replaces an individual assessment by a physician, physical therapist, or qualified fitness professional.

4. License to use

As long as you comply with these Terms, we grant you a personal, limited, revocable, non-exclusive, and non-transferable license to use the App for your own non-commercial purposes.

You may not copy, redistribute, sell, transmit, systematically record, reverse engineer, circumvent access controls, or commercially exploit videos, illustrations, text, trademarks, routines, or software unless permitted by law or authorized in writing.

5. Prohibited conduct

You may not:

use the App for unlawful or harmful purposes;
attempt to access accounts, data, servers, or functions without authorization;
interfere with the security, availability, or operation of the service;
automate the collection of content or credentials;
provide misleading information to obtain benefits or unauthorized access;
remove intellectual property notices.

6. Subscriptions and payments

Access to App content requires an active purchase. There is no free plan or free trial.

We offer recurring subscription plans and a one-time lifetime access option. The product, price, billing period, and renewal conditions displayed on the purchase screen before confirmation prevail over any amount stated in promotional material.

Subscriptions automatically renew at the end of each period and are charged to your Apple Account until canceled. You must cancel in your Apple Account subscription settings at least 24 hours before the current period ends. If canceled later, cancellation will apply only to the following period. Access continues until the end of the period already paid for.

The lifetime purchase is a one-time payment, does not renew, and is not charged again. It grants access to App content for as long as the App is offered and is not a promise that the service will operate for any particular period.

Prices may change. A price change to an active subscription only takes effect after notice and, when required by Apple rules, with your consent; without that consent, renewal will not occur.

Canceling a subscription, deleting the App, and deleting your account are separate actions. Neither deleting the App nor deleting your account cancels a subscription. Billing continues while the subscription is active in your Apple Account. Cancellation must always be completed through the App Store.

Apple reviews refund requests under its rules and applicable law, including withdrawal rights under Brazil's Consumer Protection Code. We do not access your payment method and do not process refunds directly, but we may assist you with an Apple request when appropriate.

If a completed purchase does not unlock access, use “Restore Purchases” on the plans screen. If the issue continues, contact us through the channel in Section 14.

7. Availability and changes

We may correct, update, add, or remove features to improve security, performance, and content. We will seek to communicate material changes that significantly reduce a purchased feature.

The service may be temporarily unavailable because of maintenance, provider failures, connectivity, or events outside our reasonable control. We do not guarantee uninterrupted operation, but we will make reasonable efforts to restore service.

8. Content and intellectual property

The App, its technology, and its content belong to Marcus Flávio Costa Magalhães or are used under license. These Terms do not transfer intellectual property rights to you.

Comments or suggestions voluntarily submitted may be used to improve the product without disclosing your identity and in accordance with the Privacy Policy.

9. Privacy

Personal data is processed under the Privacy Policy available at https://alongafacil.com.br/privacy, which forms part of these Terms. Analytics, notification, and account-deletion settings are available in the App as each feature is implemented.

10. Suspension and termination

You may stop using the service and delete your account. We may suspend or terminate access for violations of these Terms, fraud, security risks, or legal obligations, with notice and an opportunity to remedy the issue when appropriate.

Provisions that by their nature must survive—such as intellectual property, liability, overdue payments, and dispute resolution—remain in effect after termination.

11. Liability

We are liable within the limits of applicable law. We do not exclude liability that cannot legally be excluded, including liability for security or data-processing failures attributable to us.

The App relies on information you provide and cannot assess your execution, medical history, or environment in person. Physical results vary between individuals and are not guaranteed.

12. Governing law and dispute resolution

The laws of the Federative Republic of Brazil apply, including the Consumer Protection Code and the LGPD where applicable. You may seek assistance from consumer protection authorities and the competent court guaranteed by law; these Terms do not require you to waive legally protected rights.

13. Changes to these Terms

We may update these Terms to reflect legal or product changes. We will communicate material changes and request renewed acceptance when required. The current version and date appear at the beginning.
